3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You may register using:

  • Email and password
  • Google OAuth authentication
  • GitHub OAuth authentication

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring all information provided is accurate and current

4. Subscription Plans and Billing

4.1 Plans Available

  • Free Plan: 50 tokens per month, basic features
  • Pro Plan ($29/month): 1,000 tokens, advanced features
  • Business Plan ($99/month): 5,000 tokens, priority support
  • Enterprise Plan: Unlimited tokens, custom pricing

4.2 Token System

Our Service uses a token-based system where different operations consume tokens:

  • Website Generation: 15 tokens
  • AI Chat: 1 token per message
  • Code Modification: 5 tokens
  • Deployment: 3 tokens
  • File Analysis: 2 tokens
  • Template Customization: 8 tokens

4.3 Payment and Billing

  • All payments are processed securely through Stripe
  • Subscriptions renew automatically on a monthly basis
  • Tokens reset on the 1st day of each month
  • Unused tokens do not roll over to the next billing period
  • All fees are non-refundable except as required by law

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Generate or distribute malicious, harmful, or illegal content
  • Infringe upon intellectual property rights of others
  • Create phishing sites or fraudulent websites
  • Generate spam, malware, or other malicious code
  • Scrape, harvest, or collect user data without permission
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Resell or redistribute our Service without authorization
  • Use the Service for any illegal or unauthorized purpose

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by iSites.biz and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain all rights to the content you create using our Service. By using the Service, you grant us a limited license to:

  • Store and process your content to provide the Service
  • Use your prompts to generate AI responses
  • Create backups and ensure service availability

6.3 AI-Generated Content

Code and content generated by our AI is provided to you for your use. However, we cannot guarantee that AI-generated content does not infringe on third-party rights. You are responsible for ensuring compliance with applicable laws and third-party rights.

7. Third-Party Services

Our Service integrates with third-party services including:

  • OpenAI and Anthropic for AI generation
  • Stripe for payment processing
  • Google and GitHub for authentication
  • Firebase for data storage
  • Netlify for hosting

Your use of these services is subject to their respective terms and conditions. We are not responsible for the practices of third-party services.

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Results

We do not guarantee that:

  • The Service will meet your specific requirements
  • AI-generated code will be error-free or optimal
  • Generated websites will be suitable for your intended purpose
  • The Service will be uninterrupted or secure

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ISITES.BIZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Violation of our Acceptable Use Policy
  • Fraudulent or illegal activity
  • Extended period of inactivity

Upon termination, your right to use the Service will immediately cease. We will make reasonable efforts to provide access to your data for a limited period after termination.

You agree to defend, indemnify, and hold harmless iSites.biz and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service

  • Content you generate or publish using the Service

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
